This Warning, Waiver and Release of Liability and Agreement to Participate (hereinafter “Agreement”) is made between , (hereinafter “Participant”) and Grand Mountain Jiu-Jitsu LLC, DBA Gracie Humaita Beaumont AND any affiliated coaches, instructors (permanent, substitute, volunteer or visiting), applicable owners, personnel and officials, (all hereinafter referred to as “The School”).
Participant acknowledges and fully understands that he/she will be engaging in a contact sport, namely Jiu-Jitsu and Muay Thai, that carries the inherent risk of serious injury, including permanent disability and/or death. Participant fully assumes all said risks and Participant accepts responsibility for all damages, legal expenses and otherwise, in the possible event of personal injury, damages and/or death as well as other risks not reasonably foreseeable.
Participant, on behalf of himself/herself, as well as Participant’s family, heirs, executors, administrators, and assigns hereby releases, waives, and otherwise discharges and hold harmless The School of any and all injury and loss howsoever caused to any person and/or property including but not limited to claims, liability for damages, demands, losses (social and economic), personal injury otherwise in the event of injury including permanent disability and/or death.
Participant agrees and hereby stipulates not to sue or bring legal action in any form against The School or against Isaac Morales, Gracie Humaita Beaumont, Grand Mountain Jiu-Jitsu LLC, Gracie Humaita, Gracie Humaita Temecula, Royler Gracie, Ricardo Guimares, Isaac Morales, or any other owner(s) and/or personnel of The School in the event of injury and/or damages including but not limited to personal injury and/or death, claims, liability for damages, demands, losses (social and economic) caused or alleged to be caused in whole or in part by the negligence of The School.
Participant also agrees to release, waive and otherwise discharge The School from any and all liability resulting from damages, personal and otherwise, as outlined above in connection with participant at The School or participation in activities sponsored or connected with The School including, but not limited to, travel to and from The School, tournaments, practice, clinics and any other venues in which The School is a vendor or participant.
Participant acknowledges that he/she has received a completely executed copy of this Agreement
Participant confirms that there were no other representations or terms, oral or otherwise, other than those specified in this Agreement.
Participant acknowledges and consents that he/she may be photographed and/or filmed while attending any classes, tournaments or seminars, and he/she gives consent to The School and any affiliated to use any and all photos, video footage and/or video streaming for promotional sales, publicity, and advertising purposes for all media including the internet and Facebook.
AS EVIDENCED BY HIS/HER SIGNATURE BELOW, PARTICIPANT HAS READ THE ABOVE WARNING, WAIVER AND RELEASE OF LIABILITY AND AGREEMENT TO PARTICIPATE AND FULLY UNDERSTANDS THAT HE/SHE GIVES UP SUBSTANTIAL RIGHTS BY SIGNING SAID AGREEMENT AND KNOWING THIS, SIGNS THIS AGREEMENT VOLUNTARILY. PARTICIPANT AGREES TO PARTICIPATE KNOWING THE RISKS AND CONDITIONS INVOLVED AND DOES SO ENTIRELY OF HIS/HER OWN FREE WILL. PARTICIPANT AFFIRMS THAT HE/SHE IS AT LEAST 18 YEARS OF AGE, OR, IF UNDER 18 YEARS OF AGE, HAS OBTAINED THE REQUIRED CONSENT OF HIS/HER PARENT/GUARDIAN AS EVIDENCED BY THE SIGNATURE BELOW.

This is to Certify that I, as parent/guardian with legal responsibility for this Participant, do consent and agree to his/her release, as provided above, of The School and applicable affiliates as defined above, and for myself, my heirs, assigns, and the next of kin, I release and agree to indemnify and hold harmless The School from any and all liabilities incident to my minor child’s involvement or participation in these programs as defined above, even if arising from negligence alleged or otherwise on behalf of The School. I have instructed the minor participant as to the above warnings and conditions and their ramifications.

COVID-19 Addendum

WARNING, WAIVER AND RELEASE OF LIABILITY AND AGREEMENT TO PARTICIPATE
In response to the COVID-19 pandemic, and to ensure the highest possible standards of cleanliness and disinfection, The School has enacted the following protocols, guided by current recommendations from the Centers for Disease Control and Prevention (CDC). Additionally, the School has also developed an enhanced Contagious Illness Response Plan (CIRP) that specifically addresses actions to be taken and notifications to be made to our students, parents, and staff should a case of infectious decease be reported.
Interior Cleaning Equipment and Disinfection:
Gracie Humaita Beaumont has procured electrostatic
sprayers that will allow us to disinfect ALL surface areas inside the school. This equipment produces an electrical charge to disinfectant solutions, allowing them to wrap to conductive surfaces with an effective and even coverage. Double-charged particles envelope all conductive surfaces to include shadowed, vertical, and underneath. This is far more effective that wiping and non-electrostatic fogging, as it allows for the solutions to meet dwell times so they can work to their full capabilities. This process also reduces the likelihood of cross-contamination that can result with spray and wipe techniques, which can simply move bacteria from one surface to another.
In addition to the common disinfectants that we have always used to ensure student safety, we have now incorporated Vital Oxide, an EPA-registered hospital disinfectant that is so safe, no personal protective equipment (PPE) is required during its application. It is listed on the “EPA List N: Disinfectants for Use Against SARS-CoV-2.” With Vital Oxide, we can effectively sanitize the mats, restrooms, office desks, and seating areas and allow for school utilization within minutes. This process is similar to one now being adopted by the airline industry. In addition to our comprehensive nightly disinfecting, the process of electrostatic cleaning coupled with application of Vital Oxide will be completed after every class.
We have eliminated “dry sweeping” throughout the school. Current data assumes a virus may survive up to 72 hours on surfaces, and dry sweeping could cause it to become airborne. As such, surfaces will only be cleaned utilizing wet disinfectants.
Student Protection:
Upon initial opening and in accordance with state and county guidelines, all students, spectators, and staff will wear facial coverings.
Any students, spectators, or staff with suspected symptoms of COVID-19 will not be allowed to enter The School’s premises at any time. To protect student and public safety, The School’s staff will actively screen individuals as they enter The School’s premises. Anyone with a temperature above 100.4oF or who does not have a proper face covering will not be allowed to enter The School’s premises.
We have limited the number of students per class to provide for appropriate social distancing, and have designated physical barriers on our mats. Individuals who choose to engage in partial-contact training or full-contact grappling do so at their own risk.
Hand sanitizer has always been, and will continue to be, provided free of charge to all Participants and observers.
The School will continue to follow these and other emerging precautions identified by the CDC, state, and other applicable authorities in order to protect our employees, clients, and the public. As before the COVID-19 crisis, the safety of our students and staff continues to be our highest priority. Participants accept and approve of these protocols as reasonable and sufficient deterrents to the risks posed by the COVID-19 contagion. No activities are free from risk, especially Jiu-Jitsu and Muai Thai. Nevertheless, Participant agrees to hold harmless The School, its officers, employees, owners, and students for any personal or financial damages or criminal liabilities incurred as a result of The School’s activities.
